List of Single Source Procurements

Pursuant to New York State Finance Law Section 163(10)(b), the New York State Division of Homeland Security posts summaries of single source procurement contracts. A list of current single source procurement contracts falling under New York State Finance Law Section 163(10)(b) is below.

October 5, 2011 - Contract # C003080 - The Division of Homeland Security and Emergency Services, entered into a single-source contract with the New York Library Association (NYLA) for service related to increasing digital literacy required to fulfill the goals of a grant received through the U.S. Department of Commerce's National Telecommunications and Information Administration (NTIA) pursuant to the American Recovery and Reinvestment Act of 2009 (ARRA) and the Broadband Data Improvement Act (BDIA).

About FOIL

The Freedom of Information Law ("FOIL") provides access to records to citizens interested in obtaining records related to government operations. Records include documents, tapes and computer discs. Access to records is limited by certain exemptions including those that intend to protect privacy, the names of confidential informants and those where the production of records would impair, interfere with, cause substantial injury or endanger an individual or government operation.

FOIL does not require a government agency to provide advice or create a record.

The Committee on Open Government is charged with furnishing any person with an advisory opinion for other appropriate information regarding the Freedom of Information Law. (Public Officers Law, Article 6). You may view the Committee's website for more information.

General Information about Making Record Requests

All requests to inspect or copy records of the Division of Homeland Security and Emergency Services must be made in writing and can be emailed, faxed or mailed to the Records Access Officer. Electronic requests may also be made through DHSES's on-line FOIL Request Form. Please include your phone number, email (if applicable) and mailing address so our office can contact you with any questions. All requests to inspect or copy records, or to have copies made of records, shall adequately describe the record sought, and whenever possible, the requesting party shall supply information as to dates, file designations, and other information that may help to identify the record sought. In the event the request does not adequately describe the record sought the party will be so notified.

The easiest way to make a request is for you to complete our on-line FOIL Request Form. Simply complete the form and your request will be processed.

By Regular Mail, Email, or Fax

Although no specific form is required for a written request, you may format your FOIL request in the manner suggested by the New York State Committee on Open Government. Mail your request to the specific Office within the NYS Division of Homeland Security and Emergency Services. If you are unsure of which Office to send it to you may send the request to DHSES:

A person who has been denied access to a requested record by the Records Access Officer shall have the right to appeal the denial of access to the Records Appeals Officer. An appeal to the Records Appeals Officer must be in writing and shall be addressed to:

Fee Schedule

A fee of $0.25 per page for copies of documents and/or computer printout pages may be applied to your request. Further, according to Public Officers Law Section 87.1(c), in determining the actual cost of producing a record, an agency may include an amount equal to the hourly salary attributed to the lowest paid employee who has the necessary skill required to prepare the requested record(s).

A current list, by subject matter, of all records maintained by the NYS Division of Homeland Security and Emergency Services is available. Note: This list contains all records, whether or not available, under the New York State Freedom of Information Law (FOIL).
